Terms of Use

1. Accepting these terms

By creating an account or using the app you agree to these terms. If you do not agree, do not use the app.

2. Your license

We grant you a personal, non-transferable, non-exclusive license to use Petwellio on Apple devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, sell, rent, reverse-engineer or redistribute the app, except where that restriction is prohibited by law.

3. Your account

You are responsible for your account credentials and for what is done with your account. Tell us promptly if you believe someone else has access to it. You may delete your account at any time from Settings, from the subscription screen, or during first-run setup; deletion removes your records, and it does not cancel a subscription, which is billed by Apple and canceled through the App Store.

4. Subscriptions

• The app requires an active Petwellio Pro subscription, offered as a monthly or a yearly plan. Prices are shown in the app in your local currency before you buy.
• Payment is charged to your Apple Account at confirmation of purchase.
• A subscription belongs to the Petwellio account it was bought from: signing in to that account on another device brings it there, whatever Apple Account the device uses. It cannot be transferred to another Petwellio account, and deleting the account does not cancel it.
• The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours of the end of the period.
• You can manage the subscription, switch between monthly and yearly, or cancel it in Settings → Subscription → Change plan or cancel, or in iOS Settings → your name → Subscriptions. Canceling stops the next renewal; access continues to the end of the period already paid for.
• If a free trial is offered, any unused part of it is forfeited when you buy a subscription.
• Refunds are handled by Apple under the App Store Terms of Service. We cannot issue refunds for App Store purchases ourselves, but write to us if something went wrong and we will help where we can.

5. Acceptable use

Use the app for your own animals' records. Do not use it to break the law, to interfere with the service or its security, or to attempt access to another person's account or data.

6. Your content

What you enter stays yours. You give us only the permission needed to store, sync and display it back to you — nothing else, and nothing that lets us use it for any other purpose. We do not use your records to train anything, and we do not publish them.

7. Availability

We try to keep the app working and the sync running, but we do not promise uninterrupted service. Features may change or be withdrawn; if a change materially reduces what a paid subscription provides, you can cancel it as described above. Your records remain exportable as a PDF report while your account exists.

8. Disclaimer and liability

The app is provided "as is", without warranties of any kind beyond those that cannot lawfully be excluded. To the extent the law allows, we are not liable for indirect or consequential loss, for lost data where you have not kept your own copy, or for any decision about an animal's health made in reliance on the app rather than on a veterinarian. Nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be limited by law. Mandatory consumer protections in your country of residence apply regardless of these terms.

9. Termination

You may stop using the app and delete your account at any time. We may suspend or end access if these terms are seriously or repeatedly broken; where it is reasonable to do so, we will say why first.

10. Governing law

These terms are governed by the laws of the Republic of Belarus, except where the mandatory law of your country of residence gives you rights that cannot be set aside — those continue to apply, and you may bring proceedings in the courts of your own country where the law allows.

11. Terms required by Apple

These apply because the app is distributed through the App Store:

• This agreement is between you and us alone, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for addressing any claim about the app, including product liability claims, claims that it fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
• We, not Apple, are responsible for investigating and resolving any third-party claim that the app infringes intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

12. Changes to these terms

Updated terms are posted here with a new effective date. If a change matters to what you are paying for, we will say so in the app rather than leave you to notice.
